Terms of Service

Welcome to Prebookk (“we”, “our”, “us”). By accessing or using Prebookk at prebookk.com (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using the Platform.

If you do not agree to these Terms, please do not access or use the Platform.

Prebookk is a software platform that enables independent service providers (“Providers”) to create a personal booking page, manage appointments, and accept payments from their customers (“Customers”) online. Prebookk is not a party to any transaction between Providers and Customers.

You must be at least 18 years old and legally capable of entering into contracts under Indian law to use this Platform as a Provider. By creating an account, you represent and warrant that you meet these requirements.

Customers do not need to create an account to make bookings, but must provide accurate personal information when doing so.

4.1 Registration

To list services and accept bookings, you must register as a Provider by providing your name, email address, and other required information. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Accurate Information

You agree to provide accurate, current, and complete information about yourself and your services. Misrepresentation of services, pricing, or qualifications may result in immediate account suspension.

4.3 KYC Verification

To receive payouts, Providers are required to complete Know Your Customer (KYC) verification as mandated by Razorpay and applicable Indian regulations. This includes submission of PAN card and Aadhaar details. Prebookk does not store raw KYC documents — they are processed directly by Razorpay.

5.1 Provider Responsibilities

Providers are solely responsible for the services they offer, their quality, and fulfilling confirmed bookings. Prebookk provides the technology platform only and is not responsible for the services rendered by Providers.

5.2 Bookings

A booking is confirmed only after successful payment is received and a confirmation email is sent. Providers may not charge additional fees beyond what is listed on their Prebookk profile without prior agreement with the Customer.

5.3 Cancellations

Each Provider sets their own cancellation policy. Prebookk strongly recommends Providers communicate cancellation policies clearly on their booking page. In the absence of a stated policy, Providers should provide at least 24 hours' notice of cancellation to Customers.

6.1 Payment Processing

All payments on Prebookk are processed by Razorpay Software Private Limited, a licensed Payment Aggregator regulated by the Reserve Bank of India (RBI). By making a payment, you agree to Razorpay's Terms of Service and Privacy Policy.

6.2 Platform Fees

Prebookk charges no platform commission on transactions made through the free tier. Razorpay charges a standard payment processing fee (approximately 2% + GST) which is deducted from each transaction before settlement to the Provider.

6.3 Refunds

Refund decisions are at the sole discretion of the Provider. Prebookk may facilitate refunds through the Razorpay system but does not guarantee refunds on behalf of Providers. In cases of fraud or disputes, Razorpay's dispute resolution process applies.

6.4 Payouts

Razorpay settles collected payments to Providers' verified bank accounts as per Razorpay's payout schedule, subject to successful KYC completion. Prebookk has no control over payout timelines.

You agree not to use the Platform to:

• List or offer illegal services or services that violate any applicable Indian law.
• Provide false, misleading, or fraudulent information.
• Circumvent the payment system or attempt to collect payments outside the Platform.
• Harass, threaten, or abuse other users.
• Scrape, crawl, or use automated means to access the Platform without prior written consent.
• Attempt to gain unauthorized access to any part of the Platform or its related systems.
• Use the Platform for any activity that violates the Information Technology Act, 2000, or other applicable Indian legislation.

The Prebookk name, logo, and all Platform content (excluding Provider-submitted content) are owned by or licensed to us and are protected by applicable intellectual property laws. You may not use our intellectual property without our prior written consent.

Providers grant Prebookk a limited, non-exclusive licence to display their profile information and service listings on the Platform for the purpose of operating the service.

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Prebookk disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, Prebookk and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of revenue, loss of data, or loss of business.

Our total liability to you for any direct damages shall not exceed the amount of platform fees (if any) paid by you to Prebookk in the three months preceding the claim.

You agree to indemnify and hold harmless Prebookk and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Platform, your services, or your violation of these Terms.

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may delete your account at any time by contacting us at legal@prebookk.com.

Upon termination, your public booking page will be deactivated. Existing confirmed bookings and payment records will be retained as required by applicable law.

We may update these Terms from time to time. We will notify registered Providers of material changes via email. Your continued use of the Platform after such notice constitutes your acceptance of the updated Terms. We recommend checking this page periodically.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Karnataka, India.

Before initiating legal proceedings, both parties agree to attempt to resolve any dispute in good faith through negotiation for a period of 30 days.
